General Terms and Conditions of Sale (GTC) of PizzaTime

E-commerce in Switzerland is governed by the Federal Act Against Unfair Competition (LCD; RS 241) and the Ordinance on Price Indication (OIP; RS 942.211), as well as the provisions of the Swiss Code of Obligations (CO; RS 220). For international transactions, the rules of the European Union, notably the Directive 2011/83/EU on Consumer Rights and the Directive 2000/31/EC on E-commerce, may apply.

1. Company Presentation

This website (www.pizzatime.ch) and the services offered therein, including the sale of products (the "Products"), are operated by FormaGestion Joliat (hereinafter "we", "our", "us"). These General Terms and Conditions of Sale ("Terms") govern the use of the site, the business relations with our private customers (B2C) and professional customers (B2B), and the obligations of each party.

2. Acceptance of the Terms

By accessing the site and placing an order, you unreservedly accept these General Terms and Conditions of Sale. If you do not accept these Terms, you cannot use our services.

3. Product Description

Our products include:

  • For private customers (B2C): Pizza kits, fresh pizzas, pizza bases, accessories, and pizza ovens.
  • For professional customers (B2B): Wholesale artisanal pizza dough, fresh pizzas, professional equipment, and solutions tailored to the needs of restaurants, pizzerias, and food businesses.

Product descriptions are provided for informational purposes only and are not contractual.

4. Orders and Payments

4.1 Ordering Process

  • Orders are placed exclusively via the site www.pizzatime.ch.
  • A summary is provided before final validation.

4.2 Accepted Payment Methods

We accept several secure payment methods:

  • Worldline e-Payments
  • Credit cards (Visa, MasterCard, Maestro, etc.)
  • Twint
  • PayPal
  • B2B Invoice with 10-day net payment
  • B2C Invoice "private customer" upon advance payment
  • Cryptocurrencies (Bitcoin, Ethereum)

In B2B, specific payment terms can be discussed upon request.

5. Shipping and Delivery

  • Processing and shipping: Orders are prepared within 12 to 48 business hours after payment confirmation.
  • Delivery times: 12 to 48 hours from Tuesday to Saturday, depending on the selected shipping option.
  • Shipping methods: Delivery of packages is insured by Swiss Post, with a tracking number.
  • Click & Collect: By appointment only at the following address: Pierre-Pertuis 14, Tavannes
  • Delivery costs: delivery is free by A mail from CHF 60.- (does not include Express Lune!)
  • Liability: Liability is transferred to the customer upon confirmation of shipment.

In case of absence or incorrect address, the freshness of the products cannot be guaranteed, and no refund will be issued.

6. Foodstuffs and Perishable Products

The products sold on our site include perishable foodstuffs. To this end:

  • The cold chain must be maintained from the time of receipt of the products (refrigeration between 2-5˚C).
  • No returns or refunds are accepted for fresh products.
  • The expiration date (DLC) is indicated on each product and/or is notified on a technical sheet in the packaging. Failure to comply with the storage instructions releases us from liability.

7. Right of Withdrawal and Returns

  • Fresh products: No returns or refunds are accepted.
  • Equipment and accessories: Returns possible under certain conditions and after prior discussion.
  • Defective product: Claims to be made by email with evidence (photos) for case-by-case evaluation.

8. Liabilities

  • Liability is transferred to the customer upon order validation.
  • In case of delivery issues, liability falls to Swiss Post, except in cases of customer fault (incorrect address, absence).
  • Customers should check the composition of the products in case of allergies.

9. Disputes and Applicable Law

  • Applicable law: Swiss law.
  • Competent court: Swiss Court of Biel.
  • A right to mediation or arbitration is offered before resorting to legal action.

10. Privacy and Data Protection

We comply with data protection regulations and commit to protecting your personal information in accordance with our "Privacy Policy".

11. Modifications to the General Conditions

We reserve the right to modify these Terms at any time. Modifications will apply to new orders placed after the update of the Terms.
